Acceptable Use Policy - Free Edition
Free Edition Acceptable Use Policy
Your use of the Free Edition Services is subject to this Free Edition Acceptable Use Policy (“AUP”) in addition to the Free Edition Terms (“Terms”). If you do not agree to this AUP, you must not use the Free Edition Services. Databricks may update this AUP at any time by posting an updated version to our website. You will be deemed to have accepted any changes to this AUP if you continue to use the Free Edition Services after the AUP is updated. Any capitalized terms used but not defined in this AUP will have the meaning given in the Terms.
Prohibited Uses
You represent, warrant, and agree that you will not, and you will not permit any third party to, use the Free Edition Services in any manner listed below (collectively “Prohibited Uses”):
- to process, store, transmit, promote, or otherwise interact with Prohibited Data;
- to process, store, transmit, promote, or otherwise interact with data or content in violation of any law or any third party’s rights, including without limitation those relating to privacy or intellectual property;
- to engage in or promote any fraudulent, corrupt, deceptive, illegal (including violative of any sanctions or export controls), or similarly objectionable activities;
- to distribute, promote, or facilitate the sending of unsolicited or unlawful (a) email or other messages (including spam), or (b) promotions of any kind;
- for any discriminatory, threatening, or harmful activities, including but not limited to harassment or defamation;
- to exploit or harm (or attempt to exploit or harm) minors in any way;
- for cryptomining or any similar activity;
- to carry out cyberattacks or in any way interfere with, harm, or disrupt (or attempt to interfere with, harm, or disrupt) the security or integrity of any application, computing device, system, or network (each a “System”) of any party, including but not limited to:
- gaining unauthorized access to any System (including attempting to probe, scan, monitor, or test the vulnerability of a System);
- forging any headers or other parts of any message describing its origin or routing, or otherwise interfering with the proper functioning of any System (including any deliberate attempt by any means to overload a System);
- implementing denial-of-service attacks (inundating a target with communications requests so it cannot respond effectively or at all to legitimate traffic);
- operating non-permissioned network services (including open proxies, mail relays, or recursive domain name servers);
- using any means to bypass System usage limitations; or
- storing, transmitting, or installing malicious code;
- to interfere with, harm, or disrupt (or attempt to interfere with, harm, or disrupt) the Free Edition Services or any other Databricks product or service;
- to gain (or attempt to gain) unauthorized access to any of our Systems, products, or services;
- to develop or offer a product or service made available to any third party that could reasonably be considered a substitute for that third party’s possible subscription to or purchase of any Databricks product or service;
- to sell, resell, license, sublicense, distribute, rent, lease, or otherwise provide direct or indirect access to the Free Edition Services or any of our other products or services to any third party except to the extent explicitly authorized in writing by Databricks;
- to copy, modify, disassemble, decompile, reverse engineer, or attempt to view or discover the source code of the Free Edition Services, in whole or in part, except to the extent such activities are expressly permitted by law, notwithstanding this prohibition;
- to attempt to access, search, or create accounts for any of our products or services by any means other than our publicly supported interfaces or as otherwise authorized by us, and you further agree that you will not sign up for more than two (2) accounts for your own use of the Free Edition Services regardless of the email address or name you use to register;
- in hazardous or mission-critical circumstances or for uses requiring fail-safe performance, or where failure of the Free Edition Services could lead to death, personal injury, or environmental damage;
- to impersonate or attempt to impersonate human beings;
- to automate decision making that adversely impacts an individual’s legal rights or otherwise creates or modifies a binding, enforceable obligation;
- to automate decision making in administration of justice, law enforcement, immigration or asylum processes; or
- provide medical advice or medical results interpretation that is intended to be a substitute for professional medical advice, diagnosis, or treatment.
Prohibited Data
You represent, warrant, and agree that Your Content will not contain, and you will not promote or make available to the Free Editions Services, any data that meets one or more criteria listed below (collectively “Prohibited Data”):
- violates this AUP, the Terms, any applicable law, or the rights of a third party;
- is harmful, threatening, harassing, defamatory, obscene, deceptive, or otherwise objectionable, for example, data that includes pornography, incitements of violence, terrorism, or other wrongdoing;
- contains proprietary or confidential information;
- contains bank, credit card, or other financial account numbers or login credentials;
- contains social security, tax, driver’s license, or other government-issued identification numbers;
- contains health information identifiable to a particular individual;
- constitutes “personal data,” “personal information,” “personally identifiable information,” “special categories of data,” “sensitive personal data,” or any similar concept under applicable law; or
- you do not have the right to use with the Free Edition Services, including under applicable law that requires notice, consent, or other authorization for such use, or a legal basis for such processing under any applicable law that requires a legal basis.
You further acknowledge that the Free Edition Services are not designed or intended for Prohibited Uses or to be used with Prohibited Data and Databricks is not responsible for any harmful impact resulting from Prohibited Uses or the use of Prohibited Data.
Inactive Accounts
In general, Free Edition users are expected to be active members within the Databricks community. Your account may be considered inactive if you have not logged into your account for more than sixty (60) days or if you have not created any notebooks within sixty (60) days of creating your account. If your account is considered inactive, it may be suspended or terminated by Databricks, and any related data (including your notebooks) may be deleted.
You may perform benchmark tests of the Free Edition Services, provided that you will not disclose the results of such tests unless expressly permitted by us.
Access to and use of any third-party software, systems, products, or services (including artificial intelligence or machine learning models or services) via the Free Edition Services may be subject to additional terms and/or use policies from those third-party providers.
